Elite24 Marketing ("Company," "we," "us," or "our") provides AI voice agents, AI chatbots, marketing automation, and related digital marketing services (the "Services") to local businesses ("Clients"). This Privacy Policy explains how we collect, use, disclose, and protect information in connection with our website (www.elite24marketing.com) and the Services.
This Policy applies to two groups of people: (1) our Clients and their authorized users, and (2) the end customers, leads, and contacts of our Clients whose information passes through the Services when Clients use our AI voice agents, chatbots, or automations ("Client's Customers"). Section 2 explains what we collect from each group.

For purposes of applicable data protection law, Elite24 Marketing generally acts as a "data controller" (or "business," under the CCPA) with respect to information collected through our own website and marketing, and as a "data processor" (or "service provider") when we process data on behalf of our Clients through the Services, such as their leads' contact information used in chatbot or AI voice agent interactions.
2.1 Information We Collect From Clients
When a business signs up for our Services, we may collect:
• Contact and account information: name, email address, phone number, business name, and billing address;
• Business information: industry, services offered, pricing, scripts, policies, and other content Client provides to configure the AI Systems;
• Payment information: processed through our payment processor, Stripe (see Section 8);
• Communications: emails, support tickets, and other correspondence with our team.
2.2 Information We Collect From Client's Customers
When our Clients use the Services to interact with their own customers and leads, the Services may process, on the Client's behalf:
• Names, phone numbers, and email addresses of leads and customers contacted through AI voice agents, chatbots, or automation sequences;
• Call recordings and call metadata (such as call time, duration, and outcome) generated when an AI voice agent places or receives a call;
• Chat transcripts generated when a website visitor or lead interacts with an AI chatbot;
• Appointment, scheduling, and CRM information entered into the Platforms in connection with the Services.
This information is collected and controlled primarily by our Client, who determines what data to input and how it is used. Elite24 Marketing processes this data as a service provider on the Client's behalf and in accordance with the Client's instructions and our agreement with the Client. If you are a customer or lead of one of our Clients and have questions about how your information is used, please contact that business directly; you may also contact us and we will direct your request to the appropriate Client where required by law.
2.3 Information We Collect Automatically
When you visit our website, we and our analytics providers may automatically collect:
• IP address, browser type, device information, and operating system;
• Pages visited, time on page, referring URLs, and click activity;
• Information collected through cookies and similar tracking technologies (see Section 7).
We use the information described above to:
• Provide, configure, operate, and support the Services, including building and running AI voice agents, chatbots, and automations for Clients;
• Process payments and manage Client accounts and billing;
• Communicate with Clients about their account, support requests, and Service updates;
• Improve, troubleshoot, and secure the Services, our website, and our systems;
• Send marketing communications, subject to the preferences described in Section 14;
• Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others.
4.1 How AI Systems Use Data
Our AI voice agents and chatbots use the Training Data and scripts our Clients provide, together with real-time conversation data (such as what a caller or website visitor says), to generate responses during a call or chat session. This processing typically occurs through third-party AI model providers, including OpenAI (see Section 6).
4.2 AI Model Training
We do not use Client Content, Client Data, or the personal information of Client's Customers to train our own general-purpose AI models. Where we rely on third-party AI providers such as OpenAI, we use those providers' business or API-tier services, which under those providers' current policies are not used to train the providers' underlying models by default. We encourage Clients to review the applicable third-party provider's data use terms, as those terms can change and are outside our control.
4.3 Call Recordings and Chat Transcripts
Call recordings and chat transcripts are generated to allow Clients to review AI agent performance, train and improve scripts, and maintain quality and compliance records. Recordings and transcripts are stored in the Client's connected Platform account (for example, GoHighLevel) and/or our backend systems and are accessible to the Client and to Company personnel who need access to provide support. Clients are responsible for providing any legally required notice or consent to call participants regarding recording, consistent with applicable two-party or one-party consent laws (see also our Terms of Service, Section 14).
We retain personal information for as long as necessary to provide the Services and for the following general periods, unless a longer period is required by law or a shorter period is requested and legally permitted:
• Client account and billing information: for the duration of the client relationship and up to seven (7) years afterward for tax, accounting, and legal purposes;
• Call recordings and chat transcripts: retained for the duration of the Client's active subscription, and for up to twelve (12) months after termination unless the Client requests earlier deletion or a longer period is agreed in writing;
• Website analytics data: retained per the applicable analytics provider's default retention settings, generally up to twenty-six (26) months;
• Marketing contact information: retained until the individual opts out or requests deletion, or after a period of prolonged inactivity.
When information is no longer needed, we take reasonable steps to delete, de-identify, or anonymize it.
We use the following categories of third-party service providers to deliver the Services and operate our business. Each provider processes data under its own privacy and security terms:
GoHighLevel: our core CRM and automation platform, used to store leads, run chatbot and messaging workflows, and manage client accounts.
Twilio: our telephony and SMS infrastructure provider, used to place and receive AI voice agent calls and text messages.
OpenAI: our AI language model provider, used to generate conversational responses for AI voice agents and chatbots.
Google Analytics: used to analyze website traffic and visitor behavior.
Stripe: used to process Client payments; Stripe receives payment card and billing information directly and in accordance with its own privacy policy.
Google Cloud: used to host and store data associated with the Services.
We do not sell personal information to third parties for their own independent marketing purposes. We may share information with:
• Service providers and subprocessors listed above and others who perform functions on our behalf, under contractual confidentiality and data protection obligations;
• Our Clients, with respect to data about their own leads and customers collected through the Services;
• Professional advisors, such as lawyers and accountants, as needed;
• Law enforcement or regulators, where required by law, subpoena, or legal process;
• A successor entity in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections.
6.1 No Sharing of Mobile Information
No mobile phone number or SMS/MMS opt-in consent information collected in connection with our text messaging program is shared with, sold to, or disclosed to any third party or affiliate for that third party's or affiliate's own marketing or promotional purposes. This information is used only by Elite24 Marketing, and by the Client whose messaging program the contact opted into, to deliver the messages the contact has agreed to receive. We may share this information with subcontractors who provide customer service, messaging infrastructure (such as Twilio), or CRM functionality (such as GoHighLevel) strictly to support delivery of the messaging program, and only under confidentiality obligations — never for those subcontractors' own independent marketing use.
This section describes how we handle consent, opt-in, and opt-out for SMS and MMS text messaging sent by Elite24 Marketing or by our Clients using the Services, including AI voice agent follow-up texts and chatbot-initiated messaging.
7.1 How Opt-In Consent Is Collected
Before a phone number is added to a text messaging program, the contact must provide affirmative opt-in consent — for example, by checking an unchecked, non-pre-selected consent checkbox on a web form, verbally agreeing during a recorded or documented call, or replying to an initial opt-in text message. Consent to receive marketing/promotional text messages is collected separately from consent to receive non-marketing messages (such as appointment reminders, confirmations, or account notifications), and separately from acceptance of this Privacy Policy and our Terms of Service. No contact is required to opt in to SMS/MMS messaging in order to submit a form, book an appointment, or otherwise use our website or a Client's website.
7.2 What You're Agreeing To
By opting in, a contact agrees to receive recurring SMS and/or MMS messages from Elite24 Marketing or the applicable Client business at the phone number provided. Message frequency varies depending on the messaging program and the contact's interactions. Message and data rates may apply, as determined by the contact's mobile carrier.
7.3 How to Opt Out
A contact may opt out of receiving text messages at any time by replying "STOP" to any message received. After opting out, the contact will receive one final confirmation message and will not receive further messages from that program, except as needed to confirm the opt-out. A contact may reply "HELP" to any message to receive assistance, including how to contact the sending business directly. Opt-out requests are also honored when made directly to the Client business or to us at [email protected].
7.4 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to the terms of the contact's mobile carrier and the SMS/MMS infrastructure providers we use, including Twilio.
7.5 No Sharing of SMS Opt-In Data
As stated in Section 6.1, mobile phone numbers and SMS/MMS consent status collected through our messaging program are not shared with third parties or affiliates for their own marketing or promotional purposes.
Our website uses cookies and similar technologies (such as pixels and local storage) to operate the site, remember preferences, and analyze traffic. Categories of cookies we use include:
• Essential cookies: required for the website to function properly;
• Analytics cookies: used by tools such as Google Analytics to understand how visitors use our site;
• Marketing cookies: used to measure the effectiveness of our marketing campaigns.
You can control cookies through your browser settings, which allow you to block or delete cookies. Blocking essential cookies may affect site functionality. Where required by law, we will present a cookie consent banner allowing you to accept or reject non-essential cookies before they are set.
Client payments are processed by Stripe, a third-party payment processor. We do not store full credit card numbers on our own systems. Payment information you provide during checkout is transmitted directly to Stripe and handled in accordance with Stripe's privacy policy and security standards, including PCI-DSS compliance. We retain limited billing metadata (such as transaction dates, amounts, and payment status) as needed to manage Client accounts.
Data associated with the Services is hosted on Google Cloud infrastructure, alongside data stored within our connected Platforms (such as GoHighLevel and Twilio). We implement commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including:
• Encryption of data in transit using industry-standard protocols (such as TLS);
• Access controls limiting internal access to personal information to personnel who need it to perform their duties;
• Regular review of third-party vendor security practices;
• Use of reputable cloud infrastructure providers with their own independent security certifications.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your account or information has been compromised, please contact us immediately at [email protected].
If we discover a security incident that results in unauthorized access to, or acquisition of, personal information we hold, we will investigate the incident and notify affected individuals and/or Clients without undue delay, and in accordance with the timelines required by applicable law (which, depending on jurisdiction and the nature of the data involved, may require notice within a specific number of days). Notifications will describe, to the extent known, the nature of the incident, the categories of information involved, and steps being taken in response. Clients are responsible for notifying their own customers where the Client is the controller of the affected data and applicable law places that obligation on the Client, and we will provide reasonable cooperation and information to support that notification.
12.1 General Rights
Depending on your location, you may have some or all of the following rights regarding your personal information:
• Access: request a copy of the personal information we hold about you;
• Correction: request that we correct inaccurate or incomplete information;
• Deletion: request that we delete your personal information, subject to certain legal exceptions;
• Portability: request a copy of your information in a portable format;
• Restriction or objection: request that we limit or stop certain processing of your information;
• Opt-out of sale or sharing: we do not sell personal information, but you may opt out of targeted advertising and certain analytics tracking (see Section 7).
12.2 European Union / UK Residents (GDPR)
If you are located in the European Economic Area or United Kingdom, you have the rights listed above under the General Data Protection Regulation (GDPR) and UK GDPR. Where we rely on your consent to process your information, you may withdraw that consent at any time. Where we process information based on our legitimate interests, you have the right to object. You also have the right to lodge a complaint with your local data protection authority.
12.3 California Residents (CCPA/CPRA)
If you are a California resident, you have the rights described above under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), including the right to know what personal information we collect, use, and disclose; the right to delete personal information; the right to correct inaccurate information; and the right to opt out of the sale or sharing of personal information (we do not sell personal information as defined by the CCPA). We will not discriminate against you for exercising these rights.
12.4 How to Exercise Your Rights
To exercise any of these rights, contact us at [email protected]. We may need to verify your identity before processing your request. We will respond within the timeframe required by applicable law (generally 30-45 days, depending on jurisdiction). If you are a customer or lead of one of our Clients rather than a direct Client of ours, we may need to direct your request to the relevant Client, who controls that data.
Elite24 Marketing is based in the United States, and the third-party providers we use (including Google Cloud, Twilio, OpenAI, GoHighLevel, and Stripe) may process and store information in the United States and other countries. If you are located outside the United States, your information may be transferred to, stored, and processed in a country that may have different data protection laws than your country of residence. Where required by applicable law, we rely on appropriate safeguards for such transfers, such as Standard Contractual Clauses or equivalent mechanisms offered by our service providers.
Our Services are intended for businesses and their adult customers, and are not directed to children under the age of 16. We do not knowingly collect personal information from children. If we learn that we have inadvertently collected personal information from a child, we will take steps to delete it promptly. If you believe a child has provided us with personal information, please contact us at [email protected].
15.1 Email and SMS Preferences
If you receive marketing emails or text messages from us, you can opt out at any time by clicking the "unsubscribe" link in emails, replying "STOP" to text messages, or contacting us directly at [email protected]. Opting out of marketing communications does not affect transactional or account-related messages, which we may still send as necessary to operate the Services.
15.2 Client's Customers
If you are a customer or lead of one of our Clients and wish to stop receiving AI voice agent calls, text messages, or chatbot outreach, you can reply "STOP" to text messages, decline further contact during a call, or contact the Client business directly, since the Client controls its own contact and marketing lists. We support Clients in maintaining opt-out and do-not-contact lists within the Platforms.
15.3 Do Not Track
Some browsers offer a "Do Not Track" signal. Because there is not yet a common industry standard for responding to these signals, our website does not currently respond to them differently than described in this Policy.
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will post the updated Policy on our website with a revised "Last Updated" date, and for material changes, we will provide additional notice where required by law (such as by email or a website banner).
